By accessing and using the website and services of Optimal Care Residence LLC, you agree to be bound by these Terms of Service. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Optimal Care Residence LLC provides community engagement, transportation, and enrichment services for individuals. Services include:

• Community engagement activities and outings
• Safe, supervised transportation
• Arts and crafts programs
• Cultural and recreational trips
• Money management and shopping assistance
• Professional supervision and support

3. Service Eligibility

To use our services, you must be or represent an individual who meets our service criteria. Eligibility assessment is conducted during the initial consultation. We reserve the right to refuse service to individuals who may pose safety risks or are incompatible with our program model.

4. Participant & Guardian Responsibilities

Participants and their legal guardians/families agree to:

• Provide accurate health and emergency information
• Disclose any medical conditions or medications
• Notify us of behavior changes or health concerns
• Pay fees on a timely basis
• Maintain respectful behavior toward staff and other participants
• Follow safety protocols and guidelines
• Inform us of address or contact changes

Participants must:

• Provide current medical clearance for participation
• Inform staff of medication changes
• Follow all safety instructions
• Report injuries or incidents immediately
• Maintain appropriate hygiene
• Not participate while ill or contagious

7. Assumption of Risk & Liability Waiver

Participants and guardians acknowledge that participation in our activities carries inherent risks. By enrolling, you assume all risks associated with participation and agree to release Optimal Care Residence LLC, its employees, and agents from liability for injury, loss, or damage except in cases of gross negligence or willful misconduct.

A signed waiver form is required before service commencement.

8. Code of Conduct

All participants must:

• Treat staff and other participants with respect
• Refrain from abusive, threatening, or harassing behavior
• Not engage in illegal activities
• Follow all program rules and guidelines
• Respect the property and belongings of others

Violations of the code of conduct may result in immediate termination of services without refund.

9. Termination of Services

Optimal Care Residence LLC reserves the right to terminate services immediately if:

• The participant engages in threatening or abusive behavior
• Payment is not received for 30+ days
• Participant is no longer eligible or safe to participate
• Medical condition prevents safe participation
• Participant violates the Code of Conduct

10. Limitation of Liability

To the fullest extent permitted by law, Optimal Care Residence LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility of such damages. Our total liability is limited to fees paid in the preceding 12 months.

11. Dispute Resolution

Any disputes shall be resolved through:

1. Good faith negotiation between parties
2. Mediation if negotiation fails
3. Binding arbitration or litigation under Virginia law

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes become effective upon posting. Continued use of services signifies acceptance of modified terms.
